Tribunal's reasoning

This is a review/permission-to-appeal decision following an earlier market rent determination of 9 December 2024, not the substantive rent decision itself. The tribunal declined to review its earlier decision and refused permission to appeal, finding the landlord's grounds unarguable. The original decision had applied a £35 pcm deduction from the valuation to reflect disputed shed access and the tenant's reasonable expectation of further minor disrepair, preferring the tenant's evidence on both points, and gave little weight to two agents' valuations as they were seen as marketing pitches rather than independent evidence. No figures for current, proposed or decided rent are given in this review decision.
