£660tribunal decided (pcm)

Condition: The room, within a tired mansion block, needs modernisation with a defective fridge, poor decorations, disrepair to electrics, a leak from above, and an unrepaired shower forcing an elderly tenant to use stairs to a shared bathroom.

Evidence considered

Tenant submitted evidence: yes. Landlord submitted evidence: yes.

Tribunal's reasoning

The tribunal assessed the open market rent for the room in good condition at £1,100 pcm using its own expert knowledge and the parties' comparable evidence, then deducted 20% for disrepair/lack of modernisation and a further 20% for scarcity, giving an uncapped fair rent of £660 pcm. Although adding services would have produced a maximum fair rent of £751.50 pcm, the statutory cap under the Rent Acts (Maximum Fair Rent) Order 1999 was higher (£898.01), so the lower uncapped figure of £660 pcm was registered as the fair rent.
