No. 3 Melbourne Road, Lowestoft, Suffolk, NR32 1SR
Evidence considered
- No comparable evidence considered; the application was dismissed for lack of jurisdiction due to an invalid section 13 notice.
Tenant submitted evidence: no. Landlord submitted evidence: no.
Tribunal's reasoning
The tribunal did not determine a market rent because it found the landlord's section 13 notice invalid. The tenancy required rent to be paid on the 5th of each month, meaning the period began on the 5th, but the notice proposed the new rent take effect from 3 February 2026 — not the start of a tenancy period. As the notice failed the third statutory requirement (new rent must start at the beginning of a tenancy period), the Tribunal held it had no jurisdiction to determine a rent, and the existing rent continues until a valid notice is served.
