Neylands Farm, Grinstead Lane, East Grinstead, RH19 4HP
Evidence considered
- No comparable evidence considered; the decision turned solely on the validity of the landlord's statutory notice and did not reach a market rent valuation.
Tenant submitted evidence: unknown. Landlord submitted evidence: unknown.
Tribunal's reasoning
The Tribunal found the landlord's Section 13 notice invalid and made no determination of market rent. The notice departed significantly from the prescribed form (omitting required guidance notes and information about first rent increases after 11 February 2003, and confusingly referring to both assured tenancy and assured agricultural occupancy), such that a reasonable recipient would have reasonable doubt as to its terms. Separately, the notice's proposed effective date (1 June) did not align with the start of a tenancy period (the tenancy ran from the 13th of each month), which alone would have invalidated it. The Tribunal also noted but did not decide a dispute as to whether the parties had already agreed a lower rent, leaving that for the parties or County Court.
