Flat B, 198 Gloucester Terrace, London, W2 6HT
Evidence considered
- No comparable rental evidence was considered; the case turned entirely on the validity of the landlord's notice of increase.
Tenant submitted evidence: no. Landlord submitted evidence: no.
Tribunal's reasoning
The tribunal found there was no valid notice of rent increase under s.13A: no Form 4 was ever produced by either party, the purported notice period (via a covering letter) would have been two days too short, and the proposed effective date did not align with the tenancy's rental periods (17th of each month). Because there was no valid notice triggering the tribunal's jurisdiction, there was nothing to determine and the rent remained unchanged at the passing level of £1200 pcm as stated by the tenant.
