£1100current rent (pcm)
£1210landlord proposed (pcm)
£1150tribunal decided (pcm)

Condition: Property considered to be in overall good condition, requiring no adjustment.

Evidence considered

Tenant submitted evidence: yes. Landlord submitted evidence: no.

Tribunal's reasoning

The tribunal first rejected the tenant's argument that the landlord's section 13(2) notice was invalid due to a clerical dating error, applying the Mannai approach that a reasonable tenant would understand the intended date. On valuation, having only the tenant's comparable evidence and no landlord evidence, the tribunal used its own expert knowledge of the local market together with the comparable to assess a market rent for the property in good condition. As the property was found to be in good condition, no adjustment was made and the market rent was fixed at £1,150 pcm, below the landlord's proposed £1,210 pcm but above the previous £1,100 pcm rent.
