Flat 80 Granite Apartments 39 Windmill Lane Stratford London E15 1PZ
Condition: Modern purpose-built flat in generally good condition, though tenant reported mould around windows and non-working fire alarm; disrepair found not significant enough to justify a rent deduction.
Evidence considered
- Tribunal relied on its own general knowledge of market rent levels in the London Borough of Newham rather than specific comparable transactions.
- Tenant submitted photographs of internal mould around window frames and described unsafe communal areas, but tribunal found this insufficient to justify a reduction.
- Landlord provided only brief representations (Form 1a) and no comparable evidence.
Tenant submitted evidence: yes. Landlord submitted evidence: no.
Tribunal's reasoning
The tribunal determined the market rent using its own knowledge of local rent levels for similar modern flats in Newham, arriving at £500 per week (equivalent to about £2,166.67 pcm) assuming the property fully fitted and in reasonable decorative order. Although the tenant raised issues of mould, poor insulation, and communal safety, the tribunal found the disrepair not significant enough to warrant any deduction from this headline rent. No allowance for undue hardship was made as the tenant provided no significant supporting evidence, and the effective date of the increase (6 April 2026) was unchanged. Figures converted from weekly rents stated in the landlord's notice (£143.99 pw current, £150.90 pw proposed) to monthly equivalents.
