Flat 8 Silverwood Court, 15 Milton Road, Bournemouth, Dorset, BH8 8FF
Condition: 3-bed, 2-bathroom flat (one ensuite) in a well-maintained block 1.5 miles from the beach, with central heating, double glazing, carpeted living room, tiled bathrooms/kitchen, allocated gated parking and a communal garden (the tenant says the bike shed is unusable). The tenant has lived there over 7 years and cited normal wear and tear, plus anti-social/drug-related activity on the road.
Evidence considered
- Landlord: rents of the other 3-bed flats it owns in the same two blocks, ranging £1,485–£1,660 pcm (subject flat currently £1,350 pcm)
- Landlord: a 'Best Price Guide' of six other 3-bed/2-bath flats nearby, £1,550–£1,600 pcm, though the tribunal found these had limited supporting detail
- Tenant argued the landlord's comparables were unfairly drawn from newer, furnished, or same-landlord lettings and didn't reflect the flat's 7 years of wear and tear or anti-social behaviour on the road
Tenant submitted evidence: no. Landlord submitted evidence: yes.
Tribunal's reasoning
Weighing the comparable flats within the same blocks and its own market knowledge, the tribunal valued the property in good repair at £1,525 pcm, then deducted £50 for its unmodernised condition and general wear and tear relative to the comparables, giving £1,475 pcm.
