Tribunal's reasoning
The landlord withdrew its section 13 notice of increase and the tenant sought to withdraw the application. As both parties agreed the notice had been withdrawn, the tribunal held it had no jurisdiction to determine a market rent and struck out the application under Rule 9(2)(a). No market rent was therefore determined.
