Evidence considered

Tenant submitted evidence: no. Landlord submitted evidence: no.

Tribunal's reasoning

The tenant's application was made out of time: the referral to the Tribunal (30 April/14 May 2026) was after the effective start date (5 April 2026) specified in the landlord's section 13 notice. As the tenant did not refer the notice before the new rent period began, the Tribunal had no jurisdiction under section 13(2) (as amended) to determine a new market rent. The rent therefore defaulted to that stated in the landlord's notice of 23 February 2026, £1187.62 pcm effective from 5 April 2026, with no independent market valuation carried out.
