Flat 3, 1 Sambroke Square, Barnet, EN4 9PL
Condition: Ground floor flat with gas central heating, double glazing, carpeted bedrooms and tiled remaining areas; tenant raised outstanding disrepair issues.
Evidence considered
- No oral hearing requested; decision made on papers and the Tribunal's own expert/general knowledge of rental values in the area.
- No comparable property evidence submitted by either party.
- Landlord agreed to defer any rent increase until repairs were completed, which the Tribunal relied on in confirming the existing rent.
Tenant submitted evidence: no. Landlord submitted evidence: no.
Tribunal's reasoning
The landlord proposed increasing the rent from £1850 to £1980 pcm, but the landlord agreed to defer any increase until outstanding repairs were carried out. Given this agreement, and relying on its own expert knowledge of local rental values, the Tribunal confirmed the existing rent rather than increasing it. As the rent was not increased, the tenant's request to defer the effective date on grounds of undue hardship was moot.
