Flat 2, 4 Little Place Lane, Seaford, East Sussex, BN25 1LB
Condition: Property let in less than fully equipped condition, lacking landlord-provided white goods and curtains/blinds, with tenant paying for electricity to common parts.
Evidence considered
- Tribunal relied on comparable evidence provided by both parties combined with its own expert knowledge of local rental values
- Adjustments made from a full open market rent figure for absence of landlord-provided white goods (£20) and curtains/blinds (£10), and for tenant paying common parts electricity (£20)
Tenant submitted evidence: yes. Landlord submitted evidence: yes.
Tribunal's reasoning
The tribunal assessed the open market rent for the property in good tenantable condition at £950 pcm based on comparable evidence and its own market knowledge. It then deducted £50 in total to reflect the tenant's provision of white goods, curtains/blinds, and payment for common parts electricity (landlord only supplied a cooker), arriving at a net rent of £900 pcm. As the tenant raised no hardship argument, the new rent took effect from the date specified in the landlord's notice.
