Tribunal's reasoning
The tenant argued the rent should follow 'Affordable Rent' or 'Social Rent' benchmarks rather than the open market; the tribunal held neither concept is relevant to a market-rent determination under section 14 and disregarded them. With no market comparables from either side, it relied on its own knowledge of rents in the London Borough of Tower Hamlets, determining a full market rent of £500/week (about £2,167 pcm) with no deductions. Note: this is well above both the current and the landlord's own proposed rent — this case proceeded under the older 'sections 13 & 14' process (see also the Burnley decision in this sample), which did not cap the determination at the landlord's proposed figure the way the newer open-market-rent process does.
