Flat 1, Overcliffe Lodge, 2 Bracken Road, Bournemouth, Dorset, BH6 3TB
Condition: Flat with various disrepair including defective radiator controls, draughty double glazing, worn/moth-damaged carpets, no curtains, and damp penetration and mould.
Evidence considered
- Tenant's statement included photographs of disrepair but no comparable rental evidence.
- Landlord submitted no statement or evidence.
- Tribunal relied on its own expert knowledge of local rental values and an inspection of the property.
Tenant submitted evidence: no. Landlord submitted evidence: no.
Tribunal's reasoning
In the absence of comparable evidence from either party, the Tribunal determined a market rent of £1,050 pcm for the property in good condition on an unfurnished basis, based on its own expert knowledge and an inspection. It then deducted £20 pcm because the tenant (not the landlord) had provided the washing machine and refrigerator, and £100 pcm for general disrepair (defective heating controls, draughty windows, worn carpets, missing curtains, and damp/mould), arriving at a final figure of £930 pcm, effective from the date specified in the landlord's notice.
