Evidence considered
- Tenant submitted a list of comparable properties with asking rents
- Landlord submitted a Rightmove report of similar flats in the area with asking rents from £1,195 to £1,250
- Tribunal relied on its own knowledge of rental values in Milton Keynes alongside the comparables submitted
Tenant submitted evidence: yes. Landlord submitted evidence: yes.
Tribunal's reasoning
The tribunal determined on the papers that the open-market rent for the flat, in usual letting condition including cooker, washing machine, fridge, carpets and curtains, was £1,200 per month, based on comparable rents in the immediate area and taking into account some noise nuisance. It then deducted £25 per month because the tenant, rather than the landlord, provides curtains/blinds, giving a determined rent of £1,175 per month. This was slightly higher than the landlord's proposed rent, which the tribunal noted the landlord was not obliged to charge.
