Anchorage, Watling Street, Gravesend, Kent, DA12 5UD
Condition: Tenant alleged defects (heating, conservatory doors, front door, drainage, water pressure) but the tribunal found insufficient evidence to support these claims; property lacked usual white goods (fridge and washing machine).
Evidence considered
- Tenant cited a 3-bedroom detached house on Whitehill Road, Gravesend advertised at £1,900 pcm
- Landlord cited a 5-bedroom detached house in Fordwich Drive, Frindsbury offered at £2,700 pcm via Rightmove
- Landlord cited a 5-bedroom detached house in Harvest Lane, Gravesend offered at £2,750 pcm via Rightmove
- Tribunal also relied on its own knowledge of rental values and EPC data showing a floor area of 244 sq m
Tenant submitted evidence: yes. Landlord submitted evidence: yes.
Tribunal's reasoning
The tribunal preferred the landlord's more detailed description of a large 5-bedroom detached house and found insufficient evidence of tenant-alleged defects. Using comparable market evidence (two 5-bedroom properties at £2,700 and £2,750 pcm) and its own knowledge, it assessed a gross market rent of £2,500 pcm for a property let in usual lettable condition, then deducted £50 pcm to reflect the absence of standard white goods (fridge and washing machine), arriving at £2,450 pcm, matching the landlord's proposed rent and notice date.
