Evidence considered
- No comparable evidence considered; application struck out for lack of jurisdiction due to an invalid rent increase notice.
Tenant submitted evidence: no. Landlord submitted evidence: no.
Tribunal's reasoning
The Tribunal did not determine a market rent. It found the landlord's section 13(2) notice invalid because the proposed new rent start date (12 April 2026) did not fall at the beginning of a period of the tenancy (rent was payable on the 6th of each month under the tenancy agreement). As the notice was invalid, the Tribunal had no jurisdiction to determine a rent and struck out the application, noting the landlord could serve a fresh valid notice.
