84 Dankworth Road, Basingstoke, Hampshire, RG22 4LH
Condition: Property lacks white goods, carpets and curtains.
Evidence considered
- Neither the tenant nor the landlord submitted written submissions or comparable rental evidence.
- The Tribunal relied on its own expert general knowledge of rental values in the Basingstoke area to estimate an open market rent of £300 per week.
- A deduction of approximately 15% was applied for lack of white goods, carpets, curtains, and tenancy terms.
Tenant submitted evidence: no. Landlord submitted evidence: no.
Tribunal's reasoning
This was a Rent Act 1977 fair rent registration following a tenant objection to the Rent Officer's determination, not a section 13 market rent challenge. Neither party submitted comparable evidence, so the Tribunal relied on its own general knowledge of rental values in the Basingstoke area to assess an open market rent of £300 per week (£1,300 pcm), then deducted approximately 15% for the absence of white goods, carpets and curtains and the terms of the tenancy, giving £255 per week. No scarcity adjustment was made as there was a reasonable supply of similar properties. This uncapped fair rent of £255 per week was lower than the capped rent under the Rent Acts (Maximum Fair Rent) Order 1999 (£284.66 inc. service charge), so the lower figure of £255 per week (£1,105 pcm) was registered as the fair rent.
