Evidence considered
- No comparable evidence was considered as the application was struck out for lack of jurisdiction before any market rent assessment took place.
Tenant submitted evidence: no. Landlord submitted evidence: no.
Tribunal's reasoning
The Tribunal did not determine a market rent. It found that the tenant's application was received on 3 December 2024, two days after the new rent in the landlord's section 13 notice was due to take effect (1 December 2024). Because an application must be made before the new rent takes effect, and this statutory timetable cannot be varied by the Tribunal, it concluded it had no jurisdiction and struck out the application without considering rental evidence.

Around half of the decisions in this database cite a problem with the evidence submitted — comparable tribunal outcomes are usually what decides these cases, for both sides. We're testing a paid evidence pack and a guided walkthrough of the application, built from this database.
