Condition: Tenants reported multiple disrepair issues including roof and pipe leaks, mould, non-functioning radiators and electrics, and rotten doors, while the landlord disputed access and awareness of these issues.
Evidence considered
- Landlord submitted five comparable rental listings for similar houses in Wolverhampton ranging from £995 to £1,300 pcm.
- Tribunal relied on its own expert knowledge of local rental values alongside the comparables.
- Tenant provided photographic evidence of disrepair and of improvements they had carried out themselves.
- No tenant comparable evidence was submitted.
Tenant submitted evidence: no. Landlord submitted evidence: yes.
Tribunal's reasoning
The tribunal started from a market rent of £1,000 pcm for the property if modernised and in good condition, based on landlord-submitted comparables and its own expert knowledge of the local market. It deducted £100 for the property's poor condition relative to the comparables and £75 to reflect tenant-funded improvements, arriving at a determined rent of £825 pcm. Due to tenant hardship (reliance on housing benefit and disability), the tribunal postponed the effective date of the new rent from the landlord's proposed 1 March 2025 to 1 January 2026.
