MAN/00BS/MRA/2026/0050 · Decided 2026-08-28 · flat · 1 bed

£625current rent (pcm)
£750landlord proposed (pcm)
£750tribunal decided (pcm)

Condition: Tenant alleged disrepair (cellar damp, leaks, worn kitchen) but tribunal found remedial works largely completed and defects insufficiently serious to warrant a rent reduction.

Evidence considered

Tenant submitted evidence: no. Landlord submitted evidence: yes.

Tribunal's reasoning

The tribunal preferred the landlord's comparable evidence, including two similar flats in the same building let at £700 pcm and a nearby Rightmove listing at £795 pcm, while disregarding a retirement-complex comparable as an outlier; the tenant submitted no comparables. Although the tenant alleged disrepair (cellar damp, leaks, worn kitchen units), the tribunal found that substantial remedial works had been carried out and remaining issues were minor, so no deduction from market rent was warranted. The tribunal also rejected the tenant's undue hardship claim for lack of supporting financial evidence, so the new rent took effect from the date in the landlord's notice.
