6 Walnut Way, Emersons Green, Bristol, Gloucestershire, BS16 7GX
Condition: Modern (built 2016) terraced house with gas central heating, double glazing and a garden, in good order.
Evidence considered
- Tenant's comparable: near-identical 2-bed terraced house directly opposite the subject property in the same development, let at £1,400 pcm - given significant weight as a close match
- Landlord's comparables: two 2-bed properties let at £1,450 pcm, one with master en-suite and allocated parking, one semi-detached with garage and new carpets - given less weight due to additional features not present at subject property
- Tribunal also relied on its own general knowledge of local rental values
Tenant submitted evidence: yes. Landlord submitted evidence: yes.
Tribunal's reasoning
The tribunal preferred the tenants' comparable evidence of a near-identical terraced house in the same development directly opposite the subject property, which let at £1,400 pcm. The landlord's comparables were given less weight as they included extra features (en-suite, new carpets, garage) not present at the subject property. Using its own expertise alongside the evidence, the tribunal found the market rent to be £1,400 pcm, equal to the existing rent, and made no further adjustments. A claim of undue hardship by the tenant was rejected due to lack of financial evidence, so the new rent took effect from the date in the landlord's notice.
