Evidence considered
- No comparable evidence was considered, as the case was struck out for lack of jurisdiction before any market rent determination could take place.
Tenant submitted evidence: no. Landlord submitted evidence: no.
Tribunal's reasoning
The Tribunal did not reach the market rent question. It found the tenant's application was received on 8 April 2025, the very date the new rent proposed in the landlord's section 13 notice was to take effect, meaning it was out of time under section 13(4)(a) of the Housing Act 1988. As the statutory timetable cannot be varied, the Tribunal held it had no jurisdiction and struck out the application without determining a rent.
