Evidence considered
- No comparable evidence considered; case decided solely on a jurisdictional point regarding validity of the Notice of Increase.
Tenant submitted evidence: no. Landlord submitted evidence: no.
Tribunal's reasoning
The Tribunal declined jurisdiction without reaching a market rent valuation. It found the landlord's Notice of Increase was probably invalid on two grounds: (1) the proposed new rent date (11 June) did not coincide with the start of a new period of the statutory periodic tenancy (which began on the 12th of each month), and (2) the notice was served only 13 days before the intended effective date, short of the statutory minimum one-month notice period. As the notice was probably invalid, the Tribunal held it had no jurisdiction under section 13/14 to determine a rent.
