Evidence considered
- No comparable evidence considered; case dismissed procedurally for invalid notice before any rent evidence was assessed.
Tenant submitted evidence: no. Landlord submitted evidence: no.
Tribunal's reasoning
The tribunal declined to determine a market rent because the landlord's section 13(2) notice (dated 4 November 2024, proposing an increase from £915 to £1,500 pcm effective 1 December 2024) did not give the statutory minimum one month's notice. As the tribunal has no jurisdiction to rule on notice validity, it stayed the case pending a County Court determination of validity, per Mooney v Whiteland [2023] EWCA Civ 67, and made no rent determination.
