46C Radcliffe Road, Southampton, Hampshire, SO14 0PN
Condition: The flat has double glazing, carpets, curtains and white goods but lacks central heating and has some minor kitchen disrepair.
Evidence considered
- Landlord provided a Rightmove report of five two-bedroom properties (houses, flats, maisonette) in the SO14 postcode let at £1,100-£1,350 pcm
- Landlord cited a one-bedroom basement flat in the same building let at £675 pcm
- Tribunal gave particular weight to two flats and one maisonette comparables let at £1,100-£1,150 pcm
- Tribunal also relied on its own expert knowledge of local rental values
- No comparable evidence submitted by the tenant
Tenant submitted evidence: no. Landlord submitted evidence: yes.
Tribunal's reasoning
The tribunal assessed the market rent of this two-bedroom flat at £1,100 pcm if modernised and in good condition, based on landlord-submitted comparables of similar two-bedroom flats/maisonettes let at £1,100-£1,150 pcm plus general market knowledge. It then deducted £150 pcm for the absence of central heating and £50 pcm for minor kitchen disrepair, arriving at £900 pcm, which exceeded the landlord's proposed £775 pcm. The tenant did not submit comparable evidence or make submissions on undue hardship, so the new rent took effect from the date in the landlord's notice.
