44 Capstan Square, London, E14 3EU
Condition: Furnished single room in a shared flat with reported dampness and mould growth.
Evidence considered
- Landlord provided six comparables, some not including bills, considered broadly supportive of the proposed rent though some were better in size or amenities.
- Tenant provided no rental comparables but submitted photographic evidence of dampness and mould.
- Tribunal also relied on its own general knowledge and expertise of the local rental market.
Tenant submitted evidence: no. Landlord submitted evidence: yes.
Tribunal's reasoning
The tribunal used the landlord's six comparables together with its own market knowledge to set a baseline market rent of £1080 pcm for the room if in good condition. It then deducted £30 pcm to reflect reported dampness and mould, arriving at a determined rent of £1050 pcm. The tenant's request for a later start date to avoid undue hardship was refused due to lack of supporting evidence, so the new rent took effect from the date in the landlord's notice.
