43 Manor Park Court, Uttoxeter New Road, Derby, DE22 3NG
Condition: Standard, fairly basic specification flat with worn carpets and unrepaired damage from a leak originating in the flat above.
Evidence considered
- Tenant evidence of recent 'Let Agreed' prices for identical units on the same development, ranging £895-£915 pcm - given significant weight as directly comparable.
- Landlord evidence of two 2-bed apartments at £1,650 and £1,600 pcm - discounted as these were over-55s specialised accommodation with communal facilities, not comparable.
- Landlord evidence of a 2-bed penthouse at £1,100 pcm - discounted as having a higher specification (balconies, video intercom).
- Landlord evidence of a 2-bed flat at £1,095 pcm - tribunal unable to comment further on comparability.
- Tribunal applied a £15 pcm deduction to reflect unrepaired damage from a water leak.
Tenant submitted evidence: yes. Landlord submitted evidence: yes.
Tribunal's reasoning
The tribunal preferred the tenant's comparable evidence of recently let identical units on the same development (£895-£915 pcm) over the landlord's comparables, which it found were not truly comparable (over-55s accommodation with communal facilities, or higher specification units). Based on this it first valued the property at £935 pcm, then applied a £15 pcm deduction to reflect unrepaired damage caused by a water leak from the flat above, arriving at £920 pcm. Due to evidence of undue hardship (reduced household income following maternity leave and a C-section), the tribunal postponed the effective date of the new rent from 1 May 2026 to 1 June 2026.
