Tribunal's reasoning
The tribunal found that the landlord's section 13(2) notice, dated 12 March 2026 and proposing the new rent take effect from 1 April 2026, gave less than the required one-month minimum notice period for a monthly tenancy. Relying on Mooney v Whiteland and Atesheva v Halifax Management, the tribunal considered this apparent validity issue sufficient to decline to proceed to a market rent determination under section 14, even though it lacks jurisdiction to make a binding ruling on notice validity. Consequently no rent was determined, and the existing rent continued to apply pending a valid notice or other lawful change.
