4 Devon Court, Anzio Road, Catterick Garrison, Hambleton, North Yorkshire DL9 3EX
Condition: A dated 1960s purpose-built flat with an un-modernised kitchen and bathroom and several unresolved minor disrepairs reported by the tenant.
Evidence considered
- Tenant provided asking rents for 2-bed flats in Catterick Garrison/Colburn area (£600-£650) and one Richmond comparable, arguing landlord's comparables were for modernised, higher-EPC properties.
- Landlord provided asking rents for several Richmond properties (£700-£850) and local Catterick Garrison/Colburn comparables (£600-£750).
- Tribunal excluded all Richmond comparables as a different rental market and relied mainly on local Catterick Garrison/Colburn comparables plus its own expert knowledge.
- Tenant's list of unresolved disrepairs and self-funded improvements were noted but found not to have an appreciable net effect on rent.
Tenant submitted evidence: yes. Landlord submitted evidence: yes.
Tribunal's reasoning
The tribunal considered asking-rent comparables from both parties, excluding those in Richmond as a different rental market, and relied on its own expertise to value the property, if modernised and in good repair, at around £600 pcm. It then applied a £25 deduction to reflect that the kitchen and bathroom needed modernisation, concluding that the tenant's reported disrepairs and self-funded improvements roughly offset each other and did not otherwise affect the rent, arriving at a determined rent of £575 pcm.
