£685current rent (pcm)
£720landlord proposed (pcm)
—tribunal decided (pcm)

Evidence considered

Tenant submitted evidence: no. Landlord submitted evidence: no.

Tribunal's reasoning

The tribunal did not determine a market rent because the application was struck out for want of jurisdiction. The Section 13 notice proposing an increase from £685 to £720 pcm specified a new rent start date within 52 weeks of the date the previous increased rent (£685) took effect, contrary to section 13(3A)(b) of the Housing Act 1988. The tribunal found the notice was therefore invalid and struck out the application under Rule 9(2)(a) without considering comparable evidence or valuation.
