Tribunal's reasoning
The tribunal preferred the landlord's comparable evidence, giving most weight to two three-bedroom comparables let at £1,100 and £1,200 pcm, over the tenant's comparables which included an existing passing rent of uncertain provenance. Using its own expert knowledge of local rental values alongside the comparables, and finding the property to be in good condition requiring no adjustment, the tribunal determined a market rent of £1,050 pcm, equal to the landlord's proposed figure. The tribunal also found no case of undue hardship had been established, so the new rent took effect from the date in the landlord's notice.
