Tenant submitted evidence: no. Landlord submitted evidence: no.
Tribunal's reasoning
The Tribunal did not proceed to determine a market rent because the landlord's section 13(2) notice specified an invalid effective date (31 April, a non-existent calendar date). Applying Mannai principles, the Tribunal held a reasonable recipient could not be certain whether 30 April or 1 May was intended, so the notice failed to fulfil its statutory purpose of giving a clear, certain date. As a result no market rent was assessed and the existing rent continues until a valid notice or agreement changes it.
