3 Bridgeway, Bradville, Milton Keynes, MK13 0ES
Condition: Older (1960s/70s) terraced house with some disputed disrepair items (fencing, kitchen wall, back door, worn carpets) but landlord says double glazed, with central heating and fitted kitchen.
Evidence considered
- Landlord submitted Rightmove and OnTheMarket listings showing comparable 3-bedroom properties in the area, with the cheapest 3-bedroom in New Bradwell at £1,400 and the cheapest in Milton Keynes overall at £1,350.
- Landlord's evidence also referenced a comparable 2-bedroom property at £1,200.
- Tenant's representations focused on disrepair issues rather than comparable rental evidence.
- Tribunal relied on its own expertise and knowledge of the local market in addition to the evidence submitted.
Tenant submitted evidence: no. Landlord submitted evidence: yes.
Tribunal's reasoning
The tribunal accepted the landlord's proposed rent of £1,300 pcm as supported by comparable listings showing similar or higher rents for 3-bedroom properties in the area (from £1,350 to £1,400). It found that any deterioration in the property's condition over the long tenancy was already reflected in the landlord's proposal, so no further deduction was warranted, and disregarded the tenant's disrepair complaints as the tenant was not liable for wear and tear. The tribunal also disregarded personal circumstances of the parties and historic rent levels, focusing solely on open market comparables.
