BIR/00CU/MNR/2024/0157 · Decided 2025-06-05

£520current rent (pcm)
£620landlord proposed (pcm)
—tribunal decided (pcm)

Evidence considered

Tenant submitted evidence: no. Landlord submitted evidence: no.

Tribunal's reasoning

The tribunal found the landlord's section 13 rent increase notice invalid because the proposed start date (29 June 2024) did not fall at the beginning of a new period of the tenancy, which ran monthly from the 28th of each month (tenancy having commenced 4 October 2013). As the notice failed to meet the statutory requirement under s13(2) of the Housing Act 1988, the Tribunal held it had no jurisdiction to determine a market rent and struck out the application under Rule 9(2)(a) without making any rent determination.
