Evidence considered
- No comparable evidence was considered; the case was decided on a jurisdictional point (incomplete application) rather than on the merits of the rent level.
Tenant submitted evidence: no. Landlord submitted evidence: no.
Tribunal's reasoning
The Tribunal found the tenant's application was incomplete because a full copy of the tenancy was not provided, as required for jurisdiction under section 13(2) of the Housing Act 1988 (as amended). Without jurisdiction, the Tribunal could not determine a new market rent. As a result, the rent proposed in the landlord's original notice of increase, £2,200 pcm, took effect from the date specified in that notice (12 June 2026).
