Tribunal's reasoning
The tenant's application was made on 2 May 2026, after the effective start date (30 April 2026) specified in the landlord's section 13 rent increase notice. As the referral was out of time, the Tribunal held it had no jurisdiction under section 13(2) of the Housing Act 1988 (as amended) to determine a new rent. The rent therefore reverts by default to the figure in the landlord's notice, £3,250 pcm, effective from 30 April 2026.
