Evidence considered
- Decision based on statutory RPI-linked capping formula under the Rent Acts (Maximum Fair Rent) Order 1999, not on comparable evidence.
Tenant submitted evidence: no. Landlord submitted evidence: no.
Tribunal's reasoning
This is a Rent Act 1977 fair rent registration under the capping provisions of the Rent Acts (Maximum Fair Rent) Order 1999. The uncapped fair rent would have been £51,792 per year, but the registered rent was capped by applying the statutory formula to the previous registered rent (£40,295.69) uplifted by RPI change and a 5% statutory addition, giving a maximum fair rent of £49,237.50 per year (£4,103.13 pcm), which the tribunal registered.
