Evidence considered
- Landlord provided lettings details for the three adjoining/similar Tanyard Cottages (rents ranging £1,390-£1,590 pcm), given more weight by the Tribunal
- Landlord also provided a comparable mid-terrace three-bedroom Victorian house let for £1,590 pcm and six Rightmove comparables (£1,600-£1,950 pcm) for three-bedroom terraced/semi-detached houses, given less weight than the subject terrace comparables
- Tenant provided no comparable lettings evidence, relying instead on her status as a sitting tenant
- Property inspection report (March 2026) detailing condition and outstanding repairs was considered
Tenant submitted evidence: no. Landlord submitted evidence: yes.
Tribunal's reasoning
The Tribunal relied primarily on comparable lettings of the adjoining Tanyard Cottages (within the same terrace) and its own expert knowledge, giving these more weight than wider Rightmove comparables. Starting from a market rent of £1,500 pcm for the property if modernised and in good order with double glazing and curtains, the Tribunal deducted £125 pcm to reflect the absence of double glazing, tenant-provided curtains, and dated condition/minor disrepairs including damp, mould and poor insulation, arriving at £1,375 pcm. This exceeded the landlord's proposed rent, but the Tribunal found no undue hardship justifying a delayed start date given the tenant's financial information was outdated and not updated.
