Evidence considered
- No comparable evidence considered as the application was dismissed on procedural grounds (invalid notice).
Tenant submitted evidence: no. Landlord submitted evidence: no.
Tribunal's reasoning
The landlord's Form 4 notice of rent increase was found invalid because it proposed a new rent to take effect less than 52 weeks (53 weeks and 6 days) after the rent had last been changed by a previous Tribunal determination, contrary to s.13B(b) Housing Act 1988. As there was no valid notice, there was no new rent for the Tribunal to determine, and the passing rent of £468 per week continued to apply. No market rent comparables were considered.
