2 Bartholomew Road, Cowley, Oxford, OX4 3QQ,
Evidence considered
- No comparable evidence considered; application dismissed for lack of jurisdiction.
- A Form 4 Notice of Rent Increase stated a passing rent of £250 pcm and proposed rent of £580 pcm, but this notice was found invalid as it was not a valid notice to the applicant.
- A tenancy agreement for the whole property, held by four named individuals (not the applicant), showed a rent of £2350 from 1 March 2023.
Tenant submitted evidence: yes. Landlord submitted evidence: yes.
Tribunal's reasoning
The Tribunal found it lacked jurisdiction to determine a new rent. The applicant was found not to be a direct tenant of the landlord but rather a lodger of four individuals who held the whole property under a tenancy agreement, with the landlord's tenancy permitting lodgers. As there was no valid tenancy or Notice of Rent Increase between the landlord and the applicant, the Tribunal held the Form 4 Notice was invalid and the previously reported passing rent of £250 pcm for the room remained unchanged.
