Tribunal's reasoning
The tribunal struck out the application under rule 9(2) for lack of jurisdiction. The landlord's section 13 notice proposing a new rent appeared defective because it did not take effect at the start of a new period of the tenancy (the tenancy began on 15 May 2009 but the notice stated the new rent would start on 24 November 2025). Neither party responded to the tribunal's preliminary opinion, so the case was struck out without a market rent being determined. The applicant was left free to bring a fresh application in future.
