Tribunal's reasoning
The tribunal declined jurisdiction to determine a market rent. The tenancy agreement contained a binding rent review clause allowing annual increases by the Retail Prices Index, which falls within the exclusion in section 13(1)(b) of the Housing Act 1988. As such, the landlord's section 13 notice was ineffective and the rent must instead be increased in accordance with the tenancy agreement's own review clause, not through tribunal determination.
