Evidence considered
- Tribunal relied on its own expert knowledge of rental values in the area rather than specific comparable evidence submitted by the parties
- Landlord's calculation that historic rent increases since 2017 followed the Government (social housing rent) formula was accepted
- Dispute centred on service charges rather than the rent level itself; landlord's revised, reduced service charge figure agreed with the tenant was adopted
Tenant submitted evidence: no. Landlord submitted evidence: no.
Tribunal's reasoning
This was a social housing case where the tenant's challenge was really about the level and basis of service charges (for grass cutting and tree maintenance he said were never provided) rather than the underlying rent. The landlord accepted the issue, wrote off service charge arrears, and proposed a revised weekly figure of £103.32 (including a reduced £14.97 service charge) which the tenant accepted, based on the Government rent formula for social housing. The tribunal adopted that agreed revised figure as the market rent, effective from the date in the landlord's original notice rather than the application date, in fairness to both parties. Figures were stated weekly (£103.32, £105.57 and £98.02 per week) and converted to monthly here by multiplying by 52 and dividing by 12.
