Evidence considered
- Tenant provided two comparable 2-bed flats within half a mile let at £1450 and £1550 pcm (single bathroom, given less weight)
- Landlord provided a Tribunal rent determination of £1700 pcm for a similar flat in the same building
- Landlord provided asking rents of four 2-bed local properties with median £1750 pcm, though most had an extra bathroom
- Landlord provided an actual letting of an identical flat in the same building at £1750 pcm
- Landlord provided local estate agent advice of a rental range of £1600-£1800 pcm for the building
- Tribunal found the landlord's comparables from the same building (lettings and determinations) most compelling
Tenant submitted evidence: yes. Landlord submitted evidence: yes.
Tribunal's reasoning
The tribunal preferred the landlord's comparables, which included an actual recent letting of an identical flat in the same building at £1750 pcm and a recent tribunal determination of £1700 pcm for a similar flat in the same block, over the tenant's comparables which were of flats with only one bathroom rather than two. Using its own expert knowledge alongside this evidence, the tribunal determined the market rent at £1700 pcm, matching the landlord's proposed figure. The tenant's claim of undue hardship to delay the start date was not accepted, so the new rent took effect from the date in the landlord's original notice.
