Evidence considered

Tenant submitted evidence: yes. Landlord submitted evidence: no.

Tribunal's reasoning

The tribunal found that the landlord's section 13 notice was not served until 5 July 2026, despite being dated 5 May 2026, based on a postmarked envelope produced by the tenant and the absence of any evidence of earlier posting from the landlord. As the notice specified a new rent effective 1 August 2026, less than the statutory minimum two months' notice was given between service and the effective date. The notice was therefore invalid, and the Tribunal had no jurisdiction to determine a rent under section 14; the application was struck out.
