Tribunal's reasoning
The Tribunal found it lacked jurisdiction. The landlord's section 13(2) notice proposed a new rent starting less than 52 weeks after the rent had last been increased, making it invalid, and the landlord in any event withdrew the notice before the hearing. Once the notice was withdrawn, the Tribunal had no power to determine a market rent, so the application was struck out under Rule 9(2)(a) without any rent being assessed.
