Tribunal's reasoning
This decision concerns a landlord's application for review and permission to appeal an earlier Tribunal decision (28 February 2025) which had set aside a section 13 rent increase notice on the basis that the tenancy appeared to remain a Rent Act 1977 regulated tenancy with a registered fair rent, rather than an assured tenancy subject to section 14 market rent determination. The Tribunal refused both the review and permission to appeal, holding it had no jurisdiction to determine a market rent under section 14 while the tenancy's status as a Rent Act protected tenancy (with a registered rent of £470 pcm) remained unresolved. It directed that the question of tenancy status and any rent arrears/overpayment must first be determined by the County Court, after which any rent change would be via the Rent Officer (for a fair rent) or the Tribunal (for a market rent), as appropriate. No new market rent figure was determined in this decision.
