Evidence considered
- No comparable evidence considered; case decided solely on jurisdictional validity of the landlord's rent increase notice.
Tenant submitted evidence: no. Landlord submitted evidence: no.
Tribunal's reasoning
The Tribunal did not reach a market rent determination because it found it had no jurisdiction. The landlord's section 13 notice proposed a new rent effective 1 November 2025, but the tenancy agreement specified rent was payable on the 12th of each month (beginning of each tenancy period), and the notice therefore did not start at the beginning of a period of the tenancy as required by section 13(2). As the notice was invalid, the existing rent continued to apply and no market rent was assessed.
