Evidence considered
- Landlord comparable: Flat 1, 100 Southern Row/Way, E13 9JD - £1,600 pcm, similar size, tenancy signed 12 May 2026, treated as most persuasive due to proximity in location, size and timing.
- Landlord comparable: 2 Edwin House, London E13 - £1,675 pcm, tenancy signed 8 March 2026.
- Landlord comparable: 14 Samson House - £1,725 pcm, tenancy signed 30 January 2026.
- Tenant evidence: photographs of property condition showing alleged lack of repair/maintenance, but no comparable rent evidence submitted.
- Tribunal also applied its own general knowledge of rental values in the E13 area.
Tenant submitted evidence: no. Landlord submitted evidence: yes.
Tribunal's reasoning
The tribunal accepted the landlord's notice as valid, rejecting the tenants' argument that the tenancy's rent review date was altered by the day rent was paid. It relied principally on the landlord's comparable evidence—especially a nearby, similarly sized flat let at £1,600 pcm just before the review date—together with the tribunal's own market knowledge of E13 rents, and determined a market rent of £1,600 pcm, equal to the landlord's proposed rent. Tenant photographs of disrepair were considered but the tenants provided no comparable rental evidence and did not claim undue hardship, so no discount was applied.
